LOS ANGELES DA SEEKS DELAY IN MENENDEZ BROTHERS RESENTENCING HEARING

The Los Angeles District Attorney’s Office filed a request late Wednesday to postpone the resentencing hearing for ERIK and LYLE MENENDEZ, citing the need for comprehensive risk assessments completed by state prison and parole officers. The hearings, originally scheduled for Thursday and Friday, may now be delayed until the court obtains these reports, according to NBC News.

DISTRICT ATTORNEY NATHAN HOCHMAN emphasized that the assessments are critical to determining whether the brothers pose an unreasonable risk to the public. In response, CALIFORNIA GOV. GAVIN NEWSOM’S OFFICE clarified that the comprehensive risk assessment is ongoing and set for completion on June 13, 2025. A preliminary portion of the report was shared with involved parties 60 days prior to the clemency hearing, as required by state law, and is subject to corrections. Newsom’s office has also notified JUDGE MICHAEL JESIC of the report’s status and offered to share it with the court upon request.

The Menendez brothers, convicted in the 1989 murders of their parents, JOSE and KITTY MENENDEZ, recently discussed their hopes for freedom in an exclusive interview with TMZ. In *TMZ Presents: The Menendez Brothers: The Prison Interview*, both brothers reflected on their time in prison and their aspirations for life outside. LYLE MENENDEZ expressed optimism, stating, “We’re very hopeful. We’ve done what we can with the time we’ve had.”

Despite their claims of rehabilitation, former BEVERLY HILLS POLICE DETECTIVE TOM LINEHAN remains skeptical. “It was almost the perfect murder,” he said, describing the case as one of the most heinous he has ever encountered. Linehan further criticized the brothers, calling them “two of the most skilled liars” and warning that they could pose a danger if released.

HOCHMAN echoed these concerns, stating that the Menendez brothers have “chosen to stubbornly remain hunkered down in their over 30-year-old bunker of lies, deceit, and denials.” However, supporters, including former inmate and rapper X-RATED, argue that the brothers have paid their dues and deserve a chance at freedom. “They have helped me and many others get out of prison and rehabilitate,” he said.

The brothers have consistently maintained that they acted in self-defense, alleging years of sexual abuse by their father. Their case has been the subject of numerous documentaries and social media discussions, offering a contrasting narrative to the greed-motivated theory presented by prosecutors during their second trial in the 1990s.

If the judge decides to proceed with resentencing, the brothers could become eligible for a parole hearing under California law, which allows individuals under 26 at the time of their crime to seek parole after serving 25 years. A parole board hearing is already scheduled for June 13 as part of the comprehensive risk assessment process.
