Los Angeles County District Attorney **NATHAN HOCHMAN** and his office face a legal challenge from attorneys representing convicted murderers **ERIK** and **LYLE MENENDEZ** in their ongoing resentencing case. Attorneys led by **MARK GERAGOS** have filed a motion to disqualify **HOCHMAN** and his team, citing alleged conflicts of interest that could compromise fairness in the case. The motion was submitted to Los Angeles County Superior Court Judge **MICHAEL W. JESIC**, who oversees the proceedings.

The **MENENDEZ BROTHERS** were convicted in 1996 for the 1989 murders of their parents, **JOSE** and **MARY (KITTY) MENENDEZ**, in their Beverly Hills home. They were sentenced to life imprisonment without the possibility of parole and have been behind bars for over 30 years. Their legal team now seeks a resentencing, arguing potential conflicts involving **HOCHMAN**’s office and newly hired staff.

Geragos asserts that **HOCHMAN** deliberately excluded key personnel, including **NANCY THEBERGE** and **BROCK LUNSFORD**, both of whom supported the brothers’ resentencing, from the case. He alleges that **HOCHMAN** reassigned **THEBERGE** and **LUNSFORD** to another office and hired **KATHLEEN CADY**, an attorney who opposes the resentencing, to lead the District Attorney’s Office of Victims’ Services despite her prior involvement in the case.

Moreover, Geragos claims that **KATHLEEN CADY** has a significant conflict of interest, as she serves on the board of *Justice for Murdered Children*, an organization that has publicly opposed the **MENENDEZ BROTHERS**’ resentencing. The motion also alleges that **CADY** failed to provide victims’ families with necessary notifications about shocking crime scene images during a recent hearing.

The next court hearing is scheduled for May 30, where the motion’s merits will be debated. If granted, **GERAGOS** plans to request an evidentiary hearing and call **HOCHMAN** and other relevant parties to testify.

This case adds another layer of complexity to the brothers’ decades-long legal saga. **ERIK** and **LYLE MENENDEZ** have repeatedly contended that they acted in self-defense after enduring years of alleged abuse by their father.
