TEXAS COURT TO HEAR MOTION TO QUASH MURDER INDICTMENT AGAINST BRAD SIMPSON IN DISAPPEARANCE OF WIFE SUZANNE SIMPSON

A Texas court is set to hear arguments from defense attorneys representing BRAD SIMPSON, the suspect in the disappearance and presumed murder of his wife, SUZANNE SIMPSON, as they seek to dismiss the murder indictment against him. SUZANNE SIMPSON, a 51-year-old real estate agent and mother of four, vanished on October 6, 2024, following a reported altercation with her husband of 22 years outside their Olmos Park home in the San Antonio area. Authorities allege that BRAD SIMPSON caused her death on or around that date.

BRIAN WICE, a legal analyst and criminal appellate lawyer, told Fox News Digital that the defense’s motion to quash the indictment is unlikely to succeed. “If pre-trial motions were like the Corleone brothers, I’m thinking that the motion to quash is probably Fredo,” Wice said. He speculated that the defense may be questioning the manner and means of death but noted that even if successful, it would only prompt the state to draft a more precise indictment.

STEVEN GILMORE, BRAD SIMPSON‘s attorney, argued during a March court hearing that he has sufficient evidence to support the motion to quash the charges, which include murder, tampering with evidence, and prohibited weapons possession. The case, which has drawn national attention, was rescheduled multiple times as both prosecution and defense requested additional time to review discovery materials.

“This case stands out because it involves individuals from an affluent background, unlike many victims of violent crimes,” Wice explained. “That lens makes it a national story.”

JOEY CONTRERAS of Ramos Del Cueto, PLLC, noted that a motion to quash typically argues that prosecutors either improperly charged the offense or failed to provide adequate time for the defense to prepare. “Ideally, this buys BRAD SIMPSON time, and time always works in favor of the defense,” Contreras said. He added that the absence of Suzanne’s body complicates the prosecution’s ability to charge with specificity, giving the defense an advantage.

RONALD RAMOS, also of Ramos Del Cueto, pointed out that BRAD SIMPSON could be re-indicted if the motion is granted. Wice emphasized that Texas law allows murder prosecutions even without a body.

On the night of October 6, the Simpsons attended a party at The Argyle, an exclusive club in Alamo Heights, where witnesses reported a verbal altercation between the couple. Later, Suzanne and her daughter visited a grocery store before returning home. Suzanne reportedly called a family friend around 9 p.m., stating that BRAD SIMPSON had assaulted her. Shortly after, a neighbor observed the couple arguing violently outside their home, with BRAD allegedly chasing Suzanne into a wooded area. The neighbor later reported hearing screams.

Surveillance footage from October 7 captured BRAD SIMPSON driving his truck with heavy-duty trash bags, an ice chest, and a large item wrapped in a blue tarp. Later that day, he was seen purchasing cement, trash bags, and cleaning supplies at a Home Depot. Suzanne was reported missing on October 7, and BRAD was arrested on October 9. Authorities later discovered a burn site on his property containing a burnt laptop and multiple cellular devices. Bloodstains in his truck were presumptively identified as his own.

In December 2024, Bexar County District Attorney JOE GONZALES announced that SUZANNE SIMPSON‘s DNA was found on a reciprocating saw concealed by BRAD two days after her disappearance. BRAD SIMPSON remains in Bexar County jail on $3 million bond, with additional charges pending from the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The case continues to unfold as the court prepares to weigh the defense’s motion to quash the indictment.
